FEES
All engagements begin with a written fee agreement that clearly describes the services to be provided and the applicable fees. Clients receive detailed invoices reflecting time spent and expenses incurred. We believe fee arrangements should be straightforward, transparent, and easy to understand.
For trust administration, Durable Powers of Attorney, bill payment services, and other non-probate matters, Joseph Schafstall's hourly rate generally ranges from $150 to $250 depending on the nature and complexity of the engagement.
PROBATE COMPENSATION
Compensation for executors, administrators, and their attorneys in California probate proceedings is governed by statute and is subject to court approval. Statutory fees are generally based on the gross value of estate assets rather than the net value after debts or mortgages.
In some cases, additional compensation may be approved for extraordinary services, such as complex real estate transactions, litigation, business interests, tax matters, or other issues requiring substantial additional work.
The calculator below provides an estimate of statutory probate compensation under California law.
Enter the estimated gross value of the estate, not including debts, to calculate the statutory fees for a California Probate for estates over $184,500 but less than $25,000,000. Over $25,000,000 the court will determine a "reasonable amount."
